Can someone ask the grass eating cows what in the term firearm means compressed gas ?
Some low paid clerk tried to define firearm with his highschool level physics and we have projectile and propultion theory all inclusive, whereas the fact is that all lethal weapons which can inflict serious injury necessarily need to be powered by explosion, hence the original term firearm and hence the explosive license.
I guess grass lacks some vital nutrients for the brain.

I think you have a point. If you can get this across properly to the gent fighting the case, it would be a great achivement. It may result in defining conclusively that an airgun is NOT a "firearm"

Going by common sense and physics airgun does not appear to fall in the definition of fire-arms. But the courts have to interpret the meaning of firearm as defined by Arms Act 1959. As per Section 2(e) of Arms Act 1959:
"firearms" means arms of any description designed or adapted to discharge a projectile or projectiles of any kind by the action of any explosive or other forms of energy, and includes--
(i) artillery, hand-grenades, riot-pistols or weapons of any kind designed or adapted for the discharge of any noxious liquid, gas or other such thing,....."
If we read and understand the above definition of firearms in Arms Act 1959 then airguns do fall in the description of firearms. Arms Act 1959 appears to have been written by highly clever people where anything can mean everything or nothing at will of the government.
Moreover even if one takes a legal stand that airguns are not firearms as per arms act then logically it follows that he is also taking a stand that since airguns are not firearms under arms act, therefore the question of the need of "exemption" of airguns from provisions of arms act does not arise. Is this what we are trying to reason?

By that definition, water pistols (the Holi types) can be filled with noxious liquid, so they are firearms. Weapons designed or adapted to discharge a projectile...... no lower limit of energy, velocity, etc. Hence toy guns (Nerf, et al), catapults, bows and arrows - even the toy ones, a rubber band, are all firearms???

Yes, these were the very gentlemen who learnt law from the British, and then beat the British at their own game! Unfortunately the respected Freedom Fighters had a very blinkered view of freedom - absence of British from India, nothing about individual freedom. That's what happens if you take Joe Stalin as a role model!
In related news, today's Mumbai Mirror has it that Mumbai Police are highly concerned about the "overwhelming" numbers of replica weapons (starters) in circulation. Seems the city is queuing up to purchase replicas for 65K to 1.5 lacs, and are using them for criminal purposes!! So, one more toy goes up in smoke??!! They of course interviewed a joker who said it makes him feel important. Again some childish remark goes against the spirit of RKBA!
The article also says, as a matter of course, "arms licenses are almost never granted"! This is what we have to fight. Real RKBA, not "exempted categories". "License raj" should be done away with. So that people looking for self defense do not have to buy a dummy and pray that a criminal will mistake it for the real McCoy and run away.
Will filing individual PILs (overwhelming by numbers) help?

A Bench headed by Justice P Sathasivam also issued a notice to the Maneka Gandhi-led NGO, People For Animals (PFA), on whose petition the HC order had come.

Thanks to the apex court's intervention, the marksmen can breathe easy, for the time being. The judges, Justices P Sathasivam and J Chelameswar, issued notice to PFA and posted the matter for further hearing.
