RESPECTED SHRI MOHAN SUNDAR PANDIAN

I was given an ALL INDIA VALIDITY GUN LICENCE by HOME DEPARTMENT CHENNAI during 1994 for sports purpose to compete in national,state and departmental level competition conducted every year. well i am gazetted officer working in Ordnance Factory Tiruchy at present.

I purchased a 0.22 sporting rifle at chennai and that was endorsed in my licence.During 1994.

being a GOVT EMPLOYEE i had been transfered to other STATES in our country.Subsequently my gun licences was renewed in other States without any problems.

when i was posted at hyderabad i had applied for a second weapon with the existing gun licence. accordingly i was granted and i purchased a 0.32 revolver and the same was endorsed in my licence.
I was transfered to Ordnance Factory Tiruchy during 2006 and i got my gun licence renewed at Tiruchy Collector office for the period from 1.1.2007 to 31.12.2009 without any problem.

Now i applied for the renewal from 1.1.2010 to 31.12.2012 at the Collector office Tiruchy.The official at Collector office posted my gun licence to HOME DEPARTMENT CHENNAI mentioning that since my gun licence is of ALL INDIA VALIDITY it should be renewed at CHENNAI.Official at HOME DEPARTMENT CHENNAI posted back my gun licence to Collector office Tiruchy clearly mentioning that the DISTRICT MAGISTRATE is empowered to renew at Tiruchy.

when i went and asked the status of my renewal ,the Official at collector office did not follow the orders of the HOME DEPARTMENT CHENNAI instead questioned me how i am owing two weapons in one licence.I showed the MINISTRY OF HOME AFFAIRS ARMS ACT RULE 3(1) and 3(2) which states that a person should not own more than 3 weapon at a time.In turn i asked the Official to show me the rule which states that a individual should possess one licence for one weapon.

Now please guide me, does any ARMS ACT RULE says that seperate licence should be possessed for each weapon or in one licence 3 weapons can be possessed .

Per my knowledge, you could possess up to three, on single license, provided you've satisfied the authorities with valid reasons. Which I believe you've done already as you're possessing 2 fire-arms on one license.

Ravi,

The law as amended states that a person can't,at one time, own or carry more than 3 firearms. The three gun limit does not apply to dealers or members of a rifle club recogonised by the Govt.

The 3 firearms can be on the same license or on 3 separate licenses.The former is advisable as the date of renewal would be one where as in the latter case it would vary and would add to the work of the licensing authority and be a headache for the licensee.
