You can deposit it at the shop for as long as u wish,

The gun dealer can't confiscate it.It can only be done on the orders of the licensing authority and after passing an order.Notice has to be issued and the heirs of the deceased have to be heard.The order is again open to challenge in the court.Also,if the firearm is confiscated,then it becomes the property of the state govt.

Yes, Penpusher and Badshah, both are right. You can deposit the pistol with a gundealer/local armoury under section 21(1). as long as you wish to continue paying the rental. A lot of arms license holders have been continuously misguided by local authorities over the years starting from 1947. "One has to give an account of ammo spent" being one of the falacies, for example.

i went through a similar problem when my dad expired , here with me i have a copy of the receipt with me of a famous gun shop in mumbai where i have deposited the arms.
in one category its mentioned as" DUE DATE FOR FORFEITURE" which is exactly one yr after the date of deposition.
also the copy of the receipt is issued in triplicate one to the depositor,one to commissioner of police and another copy which the shop maintains

See Section 21 of the Arms Act,1959 and Rule 46 of the Arms Rules,1962.

Hey Guys,

Thank you for all the great advice.. the issue is that the gun is already with the Commisioner (Treasury) in Gujarat as the gun was licensed from there and thats where my dad used to live where as i am from mumbai and did not know how to get the gun here..

I am planning to go to gujarat and check if i can get it out of the treasury and put it in a arms dealers vault...

I will also check but if any of you can help i have a 1973 Beretta .22 semi automatic 8 shot i very well maintained condition...

i will try and see whats the cost of the gun if have have no other option but to sell the gun as the treasury can only hold the gun for 6 months and i am already in my 2nd renewal...

Hi mumbhai i got 2 weapons of my father transferred to me but that was after i had acquired 2 all india arms licences.its not very difficult.
