खुद की सुरक्षा के लिए शस्त्र लाइसेंस पाना लोगों के लिए मुश्किल भरा साबित हो रहा है। लंबे समय से डीएम कार्यालय में दर्जनों आवेदकों ने शस्त्र लाइसेंस के लिए आवेदन जमा किया है। बावजूद ऐसे आवेदनों पर कार्रवाई करने में जिला प्रशासन दिलचस्पी नहीं दिखा रहा है। ऐसे आवेदकों में कई सरकारी कर्मियों के साथ ही न्यायिक पदाधिकारी भी शामिल हैं। जिला प्रशासन की व्यवस्था तब सामने आती है, जब फांसी की सजा सुनाने वाले न्यायाधीश को भी शस्त्र लाइसेंस पाने में दो साल से अधिक समय का इंतजार करना पड़ता है और नतीजतन उन्हें भी लाइसेंस से वंचित रखा जाता है। नियम के मुताबिक 75 दिनों के भीतर आवेदकों के आवेदन का निष्पादन जिला दंडाधिकारी सह जिलाधिकारी को करने की बाध्यता है। मुंगेर व्यवहार न्यायालय के निवर्तमान एडीजे पंचम सह एडीजे प्रथम ज्योति स्वरूप श्रीवास्तव ने भी शस्त्र लाइसेंस के लिए दो वर्ष पूर्व आवेदन जमा किया था। एडीजे प्रथम ने हाल में ही पांच नक्सलियों को फांसी की सजा दी। इससे पहले भी उन्होंने एक अपराधी को फांसी की सजा दी थी। वहीं अपर लोक अभियोजक संदीप भट्टाचार्या ने भी वर्षों पूर्व एक शस्त्र अनुज्ञप्ति हस्तानांतरण के लिए आवेदन दिया था। ऐसे आवेदन अब भी डीएम कार्यालय में लंबित हैं। आरटीआई में नहीं मिला जवाब आरटीआई कार्यकर्ता ओम प्रकाश पोद्दार ने भी आरटीआई के माध्यम से जिले में एक जनवरी 2011 से 31 दिसंबर 2016 तक जिला दंडाधिकारी द्वारा निर्गत किये गये शस्त्र लाइसेंस की जानकारी मांगी थी। उन्होंने शस्त्र के स्वीकृत व अस्वीकृत आवेदनों का डाटा इसी वर्ष 3 अप्रैल को प्रभारी पदाधिकारी जिला शस्त्र शाखा मुंगेर से मांगा। बावजूद एक माह बाद भी उनके आरटीआई का जवाब नहीं मिला है। निर्देश का नहीं हो रहा पालन शस्त्र लाइसेंस जारी करने के लिए विभाग के निर्देश का पालन नहीं हो रहा है। वर्ष 2014 में सरकार के प्रधान सचिव आमिर सुबहानी ने सभी डीएम व एसपी को शस्त्र लाइसेंस निर्गत करने के संबंध में एक निर्देश निर्गत किया। निर्देश के मुताबिक आवेदन प्राप्त होने के बाद डीएम तुरंतजांच के लिए आवेदन एसपी को भेजेंगे। 45 दिनों के भीतर जिले के एसपी को आवेदन की जांच कराकर डीएम को समर्पित करना है। लापरवाही बरतने पर दोषी पुलिस पदाधिकारियों पर कार्रवाई का भी प्रावधान है। वहीं एसपी का प्रतिवेदन डीएम को प्राप्त होने पर वे 30 दिनों के भीतर शस्त्र लाइसेंस की स्वीकृति के संबंध में नियमानुसार निर्णय लेंगे। 75 दिनों में आवेदकों के आवेदन का निष्पादन करना सुनिश्चित है।

It's not just the judge but the prosecutor too who is awaiting his licence.

There are many conscientious and efficient bureaucrats who do care for the country and the laws, however, they are exceptions than the norm.One of the biggest curses that are inflicted upon India is the inept,lethargic,corrupt,retrograde, arrogant and self-serving and self-perpetuating bureaucracy. It has neither heart nor an open mind. The end result is not important. The process is. No matter how many individuals are ground down. Feeling particularly vexed today with it. :x

With all due respects to their posts, I have to be point blank in my comments given the fact that these gentlemen are in the Judiciary and still ignorant about ARMS ACT and RULES. If a arms licence application is not decided within three months ie 90 days , it is deemed to be granted. There are many court rulings to this effect. moreover the new ARMS RULES 2016 clearly has given atime frame for all services under the act and rules 2016. I think that these judicial high ups think that the LICENCING AUTHORITY will come to the court and present them the licencing orders. This is ridiculous and these people are DUMB AND NOT WORTH THEIR POSITONS in the context that they themselves are abetting such delays by the licencing authorities. A retired DIG of police was in the same mental envelope, saying that the licence will come calling to his house and it never did. I prey that tese people do not get a licence. If these judicial men are wort their salt, let them PROSECUTE THE LICENCING AUTHORITY (y) (y) (y) (y) (y) (y) (y)

It is the most logical thing to be done because license applicant cannot be kept sitting for ever, moreover it is a non commercial license or rather a certificate basically telling you are not offending Sections 9 of Arms Act 1959. If you could please mention these court judgments.

In my opinion , the judge should been dragged on for years and years to get his gun license.

The Indian bureaucracy is well known to be notoriously neck deep in corruption. Thus it would be reasonable to conclude hardly a file moves without greasing the palms of the relevant persons in the offices of licensing authorities. Of course there are exceptions. But exceptions only establish that normally the rule is opposite to the exception. These judges must be honest individuals or very optimistic individuals who did not think it necessary to "chase" their license application files. Following gives a small glimpse into what is actually going on in the government, if such a thing is happening in the army, that too in it's headquarters in New Delhi, one can imagine what must be happening in other wings of government -
CBI busts transfer racket at Army headquarters, arrests two

NEW DELHI: The CBI has arrested a lt colonel and a middleman in connection with a transfer racket at the Army headquarters in which officers allegedly paid lakhs of rupees to manipulate their postings.

Lt Col Ranganathan Suvramani Moni, posted in the personnel division of the Army, and middleman Gaurav Kohli were arrested while an alleged bribe of Rs 2 lakh was changing hands for the transfer of a Bengaluru based officer, CBI sources said today.

The investigating agency had learnt of the illicit activities of some Army officers and laid a trap to arrest the two men.

The agency busted the racket involving senior Army officers posted at its headquarters here. They were allegedly giving choice postings for "huge illegal gratification" which ran into lakhs for a single transfer, sources said.

The expose is bound to send ripples in the Army as some more senior officers are suspected to be involved in the case, CBI sources said.

The FIR also names Brigadier S K Grover, DDG Personnel, but his name has not been included in the list of accused.
