how to aquire licence when in military service.

friends,
my uncle is an ordinary ani captian in madras engineering regiment,who is retiring soon.he wants to know the procedure to aquire an arm when in service.any advice will be appreciated.

As per the arms act of 1959, there are only 3 reasons specified that allow a citizen to own a gun. they are

a) For self protection

b) For hunting

c) For sports and shooting competitions.

The onus to prove the above is valid is on the applicant. He has to satisfy the district magistrate (DM) on all the above counts. The DM has discretionary powers that allow him to refuse a licence for any reason he deems fit.

The Indian arms act 1959 has a special status for commissioned officers of the Indian armed forces. Any officer holding the Presidents commission is allowed to keep one weapon without a licence, provided it is approved by his commanding officer. This is a relic from the days of the Raj, when military officers had special privileges.
This privilege is applicable only to serving officers and on retirement an officer must obtain a licence from the DM

The procedure is same for all applicants under Arms Act 1959. He can apply to the licensing authority having jurisdiction at the place where he is residing.

That is exactly what it is. I don't think there is any other provision. Apply for arms license in you local DC /DM office.
As for keeping a fire arms without having acquired arm license is better avoided. Unless its from COD. Which also ultimately requires a license issued by civil administration.
Officers have burnt their fingers in the past. If an officer keeps a gun without a license issued in his name will he be able to give history of the gun to the police when dispute arises. As he cannot acquire a legal gun without a license the gun will have to be illegal one.

sir if i may ask where is he posted?? now if he is in the NE/JK then tell him to get his licence issued there since its easier for defence personel, procure the weapon of his choice through noc from anywhere in the country and then trnsfr and re register his licence and weapon at his place of residence,i hope it will solve his problem if you have any further queries please feel free to pm me,i personaly know a lot of offrs jcos n men who have followed the same route...hope this will help :cheers:
