IF MS.MANEKA GANDHI CAN........ THEN WHY CAN'T "WE"???

Post by amitkj » Sat Apr 07, 2012 4:21 pm

Dear friends

IF an immature lady like Maneka Gandhi can file a case for the amendments to be made in the existing gun laws in India..........

........... THEN WHY CAN'T WE ALL FILE A PIL (PUBLIC INTEREST LITIGATION) FOR RELAXATION OF THESE USELESS & SENSELESS LAWS???

*****************************************************************************
Edited by Mod
.

FRIENDS, LETS THINK SERIOUSLY FOR FILING THIS PIL OPTION FOR GETTING OUR NATURAL RIGHT IN PLACE OF OUR OWN & OUR FAMILY'S SAFETY. JUST POSTING NEWER & NEWER TOPICS ON THE SAME OLD SUBJECT AND THEN DISCUSSING & CURSING OTHERS AMONG OURSELVES IS NOT GOING TO HELP US.

IN THE WORLD'S LARGEST DEMOCRACY; IF AN "AIL" (ANIMAL INTEREST LITIGATION) CAN WIN...... THEN WHY NOT A "PIL"???

OTHERWISE LET'S STOP TO FEEL PROUD OF BEING A CITIZEN OF THE WORLD'S LARGEST DEMOCRACY........ AND ACCEPT THE REAL FACT THAT WE ARE ACTUALLY LIVING IN THE......... WORLD' "THE-ONLY-ANIMALOCRACY"............ WHERE ANIMAL's SAFETY IS OF GREATER IMPORTANCE THAN COMMON PEOPLE's SAFETY.

Do not take my comment in any other sense other than what I am saying.

I too am in favor of a relaxation of the gun laws and this judgement does not make much sense.

But other than this it does not take a group to file a Public interest litigation. It may just be done by an individual.

So whats keeping you waiting.... Go ahead and show us the way.

If you need any specific legal advice then put it down nicely on the forum and we have a couple of members who are good at it and may answer your queries.

So instead of shouting on the forum here go feel proud of being a citizen of the worlds largest democracy and file a Public Interest Litigation yourself. All of the other forum members as busy as you are.

You have every right to voice your opinion but you should refrain from using words like "Stupid Judgement" and "Judge should be punished " . If you are aggrieved there is a legal remedy available for you .

You might not be aware but you are accusing and finding fault with a Judge and a Judgement of a High Court in India .It is a very serious offence my friend . You can only seek legal remedy .

I am sure the moderators missed this post .

Well there is nothing wrong in using those words, a judgement can be stupid and a judge can be punished. And there is nothing to moderate in his reply.

Well Amit first of all Menaka Gandhi is not "immature lady" :). At this point she might have a stronger animal loving organization than our NAGRI. Moreover she is known all over India. Our gorilla is still a baby so let's keep feeding it till it gains weight and becomes 800 lb gorilla :).

But to be honest with you, communication is very important between an organization and it's members. I havnt received any documentation of my membership from nagri yet nor I got any email replies from them. I don't even know if they received my membership application :(. Moreover there is no update on their website. I guess their first meeting was in 2010, then when I'd the next meeting? What happened to the action items of the last meeting? Looks like I have to file a RTI to find out this information haha :)

Hello Amit,
Everyone on this forum support RKBA and look forward to a day when the gun laws are amended to make legal possession of guns easier. For this we must opt the legal route through petitions, PIL etc.

HERE I MUST SAY THAT **************************************************************************** WHICH IS INDIRECTLY AN "ANTI-COMMONMAN" JUDGEMENT......... AND THAT TOO IN WORLD'S LARGEST DEMOCRATIC (?) NATION.
It is against the law to publish something against a court's decision.

Sec 2 of 'Contempt of Courts Act, 1970'--
"(ix) contempt by speech or writing may be by scandalizing the court itself, or by abusing parties to actions, or by prejudicing mankind in favour of or against a party before the cause is heard."

Kindly make necessary changes in your post.

Publish means to communicate and is not confined to publishing in Media .
A layman will find it weird but the law of the land says that Ignorance of law is no excuse so you are supposed to know the law.
Supporting someone who's act leads to contempt of court is also deemd to be contempt of court .
And NO a Judge of a High court cannot be Punished - there are other procedures like impeachment by Parliament etc .
I hope I have put things in a simple and straight way !

Amit has somewhat managed to tell somthing we all feel more or less...Is n't it true that we have been hard done by these weird rules(I wouldn't say Laws).Especially the appeal against air guns was ridiculous. However Amit could use a bit moderate tongue.

As for Amit.. Trust me, we all share the same love and concern for guns as yours. But pls don't write in all Caps as that is considered yelling. A very friendly and cordial quote for you....

Yeah that makes sense, well I guess "legal" is the next funny language after English :)

People sometimes use harsh language when they get frustrated, same thing happened to Amit and it happens to all of us from time to time. He is frustrated coz he is in the system, and even though I am out of the system still I somewhat belong to it.

Now since mods have modified the original post, let's drop the language discussion and get back on to the original discussion.

I have heard about PILs and now I hear that they are expensive but I don't know the actual process of it, can somebody shed some light on that.

@Moderator: THANX FOR MODIFYING THIS POST WITH APPROPRIATE CHANGES.

I SINCERELY APOLOGISE FOR THE INAPPROPRIATE LANGUAGE USED IN THE POST..... AND ALSO GUARANTEE TO NOT TO REPEAT THE SAME IN FUTURE.

But one thing is for sure that any language is the sheer outcome of the feelings/frustration behind it

If you do some basic research on the internet, you will see that the PFA chaps (Ms. Gandhi's outfit) started gaining momentum in their judicial activism AFTER they were joined by a prominent lawyer who has (ever since) been filing and pursuing PIL's on their behalf. From the looks of it, he seems to be doing it for free - either because he believes in their cause OR because it gives him mileage in the media. I'd guess that it's a bit of both, with both parties coming out winners - PFA gets their judicial activism to make significant progress, their lawyer friend enhances his reputation and hopefully (for him) attracts more (paying) clients at heftier rates.

Want to see pro-gunners win some prominent legal battles? Gentlemen, you should then seriously consider using your personal networks to identify and convince a good lawyer to take up our cause in a similar manner. It would take only one member knowing the right lawyer, with the right slant of heart (pro-gun) and the willingness to take up the cause. While a collective is stronger than the individual, its strength is based on the initiative of the individuals who are its component members. So don't discount the power of ONE and start searching within your personal networks to see if you can locate a crusading pro-gun attorney!

Cheers!
