This case shows more so the fault of the photographer.
A) he didn't announce his position
B) he was too involved in his view finder to realize that he was in a very vulnerable position.

All that he had to do was to make some kind of noise, maybe whistle to let his position be known. The rest of the group wasn't aware of his presence in the sphere of fire either.

The basic rule of hunting was violated . A firearm is a friend that wants safety precautions to be observed all the time. The quail had the last laugh I suppose.
