Sir ,
Congratulations on this great feat. Many thanks and all of us are indebted to you for being the pioneer in India for RKBA. Had you not taken the first steps and decided to do something our liberty and gun ownership rights would have been lost forever. Your efforts have not only stalled the changes from being implemented and turned into a law but also brought all the gun owners together and now united we stand stronger.

The right to obtain (read import) and possess arms and ammunition is equally important.

What about government trickery in having arms 'deposited' at times of electoral periods? What guarantees are in place that the government will return legal firearms? What if those same arms are not released in time or at all, just as they have not been by various players throughout history? This is the same plank as the Fourth Amendment in the US Constitution.

Every citizen who legally holds a license, is in a form, a law abiding person, a patriot and one who does not need to bear mockery by government servants.

It's time Article 21 of our Constitution is defined clearly and followed in spirit.

It is important but a legally lengthy matter. It has to seen through a "legal eye" as what does this problem means to the law? In one aspect it may be affecting Competition Act 2002(Please refer http://indiansforguns.com/viewtopic.php ... 63#p129408) as well as various fundamental rights including RKBA as guaranteed under Articles 19 and 21 since IOF has a monopoly in market.

This trickery of government is continuing becaause no one opposed it properly in courts, due to the lack of awareness among people that RKBA is their fundamental right guaranteed under Articles 19 and 21 of Constitution. Most of the people(as well as lawyers) are under the impression that "arms" are just a privilege "granted" to citizens by Government and government can practically do anything about this "privilege" under one excuse or the other.
What guarantees are in place that the government will return legal firearms? What if those same arms are not released in time or at all, just as they have not been by various players throughout history? This is the same plank as the Fourth Amendment in the US Constitution.
No guarantees except those provided by the Constitution under Part III, if those guarantees are infringed one may approach High Court under Article 226 of Constitution or Supreme Court under Article 32 of Constitution. Unfortunately we do not have something like Fourth Amendment in the US Constitution. Probably since the framers of the Constitution(or those who influenced the Constitution) at that the time of its writing, were of "Socialist" leanings and wanted to give more powers to Government. Even the language of Article 21 was cleverly whittled down, to reduce its scope like replacing "individual liberty" with "personal liberty" and "according to due process of law" being replaced by "according to procedure established by law". Fortunately Supreme Court has over a period of time recognized "due process of law" in its interpretation of Constitution.

It is due to over delegation of powers by Parliament to the Executive under Arms Act 1959. It will continue until this aspect is reviewed by courts and utter that Articles 19 & 21 guarantee RKBA or Parliament amends Arms Act 1959 to reduce the discretionary powers delegated to the executive.
It's time Article 21 of our Constitution is defined clearly and followed in spirit.
As compared with Article 21 I think it is Article 19 is much more clear in guaranteeing RKBA. If we read Article 19(1)(b) can anyone tell me what is the use of "and" in Article 19(1)(b)? It says:

(b) to assemble peaceably and without arms;

If we remove "and" does it not make the meaning more simple and straightforward? It would look like:

(b)to assemble peaceably without arms;

If arms is not a fundamental right, then why even mention about arms in a provision that is used for guaranteeing the fundamental rights, when there is already a separate provision in Article 19(1)(3) to put restrictions on Article 19(1)(b)?

Let us have a look at some more similar Articles in Article 19. Articles 19(1)(a) and 19(1)(e). They say:

(a) to freedom of speech and expression;

(e) to reside and settle in any part of the territory of India;

Do we see the logic behind use of "and" now? It is being used to join two rights. Article 19(1)(b) is not taking away any right by saying "without arms". It is merely saying that Constitution is taking the burden on itself on behalf of the citizens to guarantee them freedom to assemble peaceably if they exercise this freedom, without another freedom for arms. In other words the Constitution is clearly acknowledging existing of both the freedoms if exercised separately from each other. Otherwise the question of using "and" to join and then excluding by saying "without arms" does not arise if arms are not a fundamental right under Part III of Constitution.
