Greetings from a Lawyer currently in US.

Fellow IFG members,

It gives me immense pleasure to join the community. I have been following the posts since the last few months to have an idea of how the RKBR in India is progressing. I have been a firearm enthusiast and always had a gun at home because of the long military heritage and my father is the 7th generation in the army.

I am 26 and graduated from the National Law University, Jodhpur in 2008. subsequently was the Assistant to the Additional Advocate General for the State of Rajasthan. In 2009 August I joined University of California at Los Angeles to pursue my LL.M. (Post Graduate degree in law). One of my focus areas here was on the Second amendment to the US constitution and I wrote a research paper titled "searching the right to bear arms under the Constitution of India". It is expected to be published by the end of this year or early next year. I will be back in India in June and unfortunately will not be able to carry a firearm as I do not fulfill the prerequisites for the same.

I will very soon be challenging the validity of the ban imposed on the import of firearms in India by the Ministry of Finance. The project is underway and I need the help of all the members here. The further details of the legal action proposed is posted under the RKBR section. I hope to contribute effectively on the forums and welcome if anyone wants any specific legal opinion. As per the Bar Council of India I cannot solicit clients and my offer to render legal opinion only is limited to the forum and does not in anyway constitute any lawyer-client relationship.

I do not have a firearm license as of now but will apply for one as soon as I am back in India. Back home in India my dad possesses 7.62 mm x 25 mm Tokarev pistol. After obtaining my license I would love to procure a bolt action rifle and a pump action shotgun which unfortunately will be a mammoth task. I had the opportunity to shoot many guns during my stay in US from Sig 9mm to AKs, M4 and .50 Barret. I hope we all can effectively make the right to bear arms in India a meaningful right which as of now is an illusion.

Thanks for your reply. The majority of my time spent at UCLA School of law was studying the second amendment. I have been visting the LA gun club i downtown LA as a part of my academic class (professional benefits) and had the pleasure of interacting with ATF(Alcohol, Tobacco and Firearm) officials. I also visited the LA Police tactical Academy and used an Uzi. Its been an awesome experience with guns here. Do see my post under RKBA.

The law has not changed so far. It is onlay a policy under consideration and until a notification to this effect is issued it cannot be implemented. I am not too sure that whether the notification has been issued or not. The core law still is the same and the new guidelines will not much of a difference.

I have provided a detailed proposal. I will need a lot of volunteers to have a pan India approach. There will be a lot of RTI work required in different states all across India. I highly appreciate and value your support. I look forward to a greater consensus on this issue.

Welcome aboard thats heartening to see that your are focusing your LLM research on civil rights and RKBA in particular unlike Corporate, financial law etc where typically most of the folks go for obvious reasons. Few days back I was stuck in Jersey City trying to get on the Street with Indian shops / resteraunts, the street name was Dr Ambedkar street. I know he was a Columbia Law School graduate and lived in NYC not sure why the street was named after father of the constitution.

I specialize in constitutional governance and litigation. I do acknowledge that majority of the lawyers are into corporate as the law firms pay the highest salaries but i enjoy litigating in the courts and trying to make greater policy changes than sitting before a computer and counting money for others. As regard Dr. Ambedkar street I have no idea why the street was named after his name. I highly appreciate Dr. Ambedkar for his work on the Indian Constitution but unfortunately he disappointed me and many others as he was the one who opposed the motion for having the right to bear arms in the constitution.

I will try and be as active as possible on the forum. This forum is an amazing platform to discuss, debate and learn a lot of things.
