Stun guns- Is it legal in India

Post by jd » Mon May 12, 2008 12:55 am

Is there any laws which says, stun guns are illegal ? Which government agency can give a right answer?
Anybody please help. I am attaching some links for stun gun details.

i read the arms act, as i am out of station so unable to get the arms act.

you have to look at the wording, as when arms act was complied, the stun gun was not around, as we have it today. so u may not find the word stun gun.

the wording to look for is like electric gun etc.

i am positive about this. sorry at the moment i am unable to point u to the act itsef.

strangeky enough a thorough perusal of section 2 (h) and(i)(ii) reveals the following.
2 (h)"prohibited ammunition" means any ammunition containing or designed or adapted to contain, any noxious liquid, gas or other such thing, and includes rockets, bombs, grenades, shells,(missiles,)articles designed for torpedo service and submarine mining and such other articles as the Central Government may, by notification in the Official Gazette, specify to be prohibited ammunition.
2 (i)(ii)weapons of any de.scription designed or adapted for the discharge of any noxious liquid, gas or such other thing, and ............. (which are not relevant to this thread)
The emphasis is mine to highlight the relevant portion, in which case pepper spray, Mace Etc are prohibited arms but stun guns are perfectly legal.

IF you guys could arrange a "pepper spray 'shooting" competition.

& winner advances to the stun gun challenge

could always call it the "pep spray club"

Well, noxious means harmful to living things/ injurious to health and pepper spray mace has no long lasting effects - other than the hurt ego of the attacker. Therefore it can be easily argued that this section does not apply.

Spraying perfume into a persons eyes could potentially cause permanent injury, so I think they should ban the sale of deodorants and perfume sprays first - wouldn't you agree? ;)

Cheers!
