The accused was carrying the gun of his father for the latter's defence and in his presence.Held that the accused was not acting illegally in possessing the loaded gun of his father and he had a right to use the gun for defending the bidy of his father as also of his own body the use of fire-arms or ammunition for a lawful purpose of defending one's own body of that of another person is not an offence contemplated by section 27 of the Arms Act. (Ram Swarup V. State:1972 Cr Lj 1119 (ALL)); & (Karnail Singh V. State : 1977 Cri Lj 1729 (Raj.)).
