Re: RTI query to Delhi Police and its Response (Delhi Police
I was hoping to see some form of advice from our mods about what is being proposed here. Their opinion and support would be key to making sure that we don't take any mis-steps.

Moin, thanks for the enthusiasm. While your question can only be answered once all of meet and discuss the possibilities, personally I'd like to challenge the followingMoin. wrote:So what specific sections of the Arms Act are being challenged in court. Commendable inititive gentlemen. How about the revision of the Sections Related to Edged Weapons too, the stupid 9" long and 2" wide clause. What can you do with a 9 inch blade that you can't do with a 6 or 7 inch blade.I can pitch in too with the moolah to support if this is really being taken seriously by all IFG'ians.
a) Assignment of ammunition quota
b) MHA Guidelines (Regard Grant or Licenses / area of validity)
c) Import Ban (According to me this is the biggest hurdle. If some big players enter the market, then they can make it worthwhile for the authorities to issues licenses!)
d) PB classification of weapons (especially for semi-automatic shotguns and rifles)
(again these are just my personal views)

I am always there to give ideas. But the main thing is to get a correct lawyer who is willing to fight in Supreme Court at manageable costs and understands the fact that arms are recognized as fundamental right under Article 19 of the Constitution.

So I've reached a stalemate with DP Licensing, as far as my RTIs are concerned.
I had sent them a letter asking about the rules that govern the 25/50 ammunition quota, their response was that they use the MHA policy.
Can I challenge this myself? Also, can I send them another RTI asking for a copy of the Gazette where this was published to satisfy Section 44 of the AA? How would I go about challenging this?

Of course you can challenge this yourself. If they are saying they are using MHA policy, you will have to challenge this MHA policy in court. Can I challenge this myself?
Yes you can send another RTI referring their response to the previous RTI. But ultimately you may have to move writ in court. Also, can I send them another RTI asking for a copy of the Gazette where this was published to satisfy Section 44 of the AA? How would I go about challenging this?

We would need to move writ in court and my suggestion would be to move things in that direction. But before we do that I'd suggest
1. We catch up with CaptRakshitSharma and Mundaire and see what their experiences in this area are. Maybe a call or a catchup over the weekend in person should help?
2. Draw out a list of lawyers who can help- I can try and do that. Take specifc help from GBM if he has any recommendations.
3. Meet the lawyers and decide legal course- figure out what it will cost and see if there are contributions that we can/should take. (do we actually need a rejection on increased quota and all india license before we can file a writ- I am not sure!)
We should reach out to the forum or larger group for specific questions/task request. Otherwise it might just lead to a lot of discussion and limited action.
Your thoughts?

SS

BTW I don't think you have to be rejected before you can challenge this.

Kandarp
