Re: gun licence for NRI
You can apply if you have proof of identity and proof of residence. When there is police inquiry from local police station, you should be available at your residence or you should be able to meet the concerned policeman. You should not have criminal records with police. In short, the local police station should be able to give a positive police report about you. You should not suppress or lie about any information that is asked in the arms license application. Avoid giving unnecessary or extra information or documents that are not asked in the arms license application form. Once you get the arms license, you can get any of your family members endorsed as a retainer on your license. This will allow them to legally possess and carry your firearm on your behalf especially when you are outside India.

Hi goodboy_mentor,
i am a licence holder ,issued by Comm. of police,Thane (Maharashtra)
I have told by authorities here (in 2001) that retainer thing has been scrapped.Even your family members
have to be licence holders themselves.
I dont know whether this is only for state of Maharashtra or whether this law is there at all nowadays
regards

Re: gun licence for NRI
Thanks for correcting me. If one reads http://www.abhijeetsingh.com/arms/india ... e_III.html it appears that this option for retainer under FORM III-A has been omitted by G.S.R. 1, dated 19th December, 1997 (w.e.f. 3rd January, 1998). In my opinion this move by government appears arbitrary, unreasonable and unconstitutional(Article 13 does not allow laws inconsistent or in derogation to fundamental rights, arms are a fundamental right under Articles 19 and 21 and equality before law is guaranteed by Article 14), it has only omitted it for individuals but kept the option for retainers intact for the companies. Moreover Arms Rules 1962 has been passed by the Parliament, have the changes to the Rule 13 of Arms Rules 1962 related to retainers also been passed by the Parliament?
