City police serves a bitter brew for night owls

I honestly see no practical benefit coming out of it re law and order. The police in Hyderabad used to come up with these devices.No restaurants are to stay open after 0000 hours. Unbelievable.

This appears to be high handedness on part of police based on conjecture that vendors indirectly help promote anti-social activity. Countless activities "indirectly" help promote anti-social activity. It does not mean all those countless activities need to be prohibited in violation of the fundamental rights. For example many crimes take place in trains or buses running at night. It does not mean that train or bus services are to be prohibited at night.

This rule is in direct violation of the fundamental right guaranteed under Article 19(1)(g) of the Constitution of India. It guarantees the right to practice any profession, or to carry on any occupation, trade or business. This right includes the right to do profession, occupation, trade or business at night.

Also this rule is in violation of right to assemble peaceably guaranteed under Article 19(1)(b)
and right to move freely throughout the territory of India guaranteed under Article 19(1)(d).

Instead of taking high handed approach against easy and soft targets, the police should channelize its energies to catch the real criminals.

the tea sellers are actually trading without a business license; not paying business tax, using public property to set up shop. so its not like stopping them is unconstitutional.
However i do agree that the rationale is flawed.

If I am not mistaken it also includes bakery's which do have licenses. About the taxes I dont know, well in our country getting papers from the govt is unfortunatly such a hassle.

If they do not have business license, are not paying taxes or using public property, there is a due process of law to be followed to make them comply with all these things by the concerned government departments. The Constitution does not empower the Police to overstep the jurisdiction of other government departments, bypass the due process of law and give arbitrary orders to prohibit them from earning their livelihood.
