Subject: Violation of the State Emblem of India (Prohibition of Improper Use) Act 2005 and the State Emblem of India (Regulation of Use) Rules 2007 by the Delhi State Rifle Association.

Sir,

Please find attached here with the original National Emblem of India along with the insulted image of our emblem by the Delhi State Rifle Association, D - 77, Panch sheel Enclave, New Delhi - 110017.

Hence you are requested to please direct the concerned SHO to book the Delhi State Rifle Association for the violation of the State Emblem of India (Prohibition of Improper Use) Act 2005 and the State Emblem of India (Regulation of Use) Rules 2007.

Naresh, it would be great if you post your introduction in "Introductions and Welcomes" section and your interest in guns and gun rights.

Have you ascertained whether the representation of ashoka pillar without the words "styamev jayte" in devnagri script means "emblem" under State Emblem of India (Prohibition of Improper Use) Act 2005? Just the ashoka pillar or its representation is not a personal and private property of government but is a part of our common shared historical heritage and thus no person or State can take exclusive ownership of its use over it. The ashoka pillar representation used by DSRA can be seen at http://delhistaterifleassociation.org/

As per Section 2(b) of State Emblem of India (Prohibition of Improper Use) Act, 2005
"emblem" means the State Emblem of India as described and specified in the Schedule to be used as an official seal of the Government. In the Schedule the State Emblem of India is represented by ashoka pillar and styamev jayte in devnagri script written below it.

Even if we consider the representation of the historical ashoka pillar without the the words "styamev jayte" in devnagri script to mean the State Emblem under Section 2(b) of State Emblem of India (Prohibition of Improper Use) Act, 2005, have you ascertained from DSRA whether they have taken permission under State Emblem of India (Prohibition of Improper Use) Rules 2007.

I am wondering as to what are your real motives behind all this? Or all this is just an attempt to be in news and get attention? :)

What in the world does the "International Organisation for Animal Protection" have to do with the National Emblems Act? BTW how has Delhi State Rifle Association earned your organisation's wrath? Unless protecting "clay birds" and paper targets is part of your mandate... :roll:

Hotel Raj mahal palace in Jaipur was under a similar violation for using the 'national emblem'. The GOI asked them to remove it. However the emblem was a part of the building so in order to 'remove' it ,some part of it had to be demolished.
The hotel building was constructed before indipendence before it was a national symbol and hence didnt have the words satyamev jayate. The architect at the time must have decided that the 4 lions would look good on a palace.
At that time it was under Taj group/diya durga group (just at the cusp of handover) and had access to the best corporate lawyers. The only defence was that the building was heritage and before indipendence. Im not 100% sure what happened in the end (the official version in courts) but the point is those lawyers didnt use the satyamev jayate defence. Of course its just a co-incidence :wink: that this directive came at the time the hotel was fighting the govt which was trying to acquire the land.
Of course in reality the hotel gave a few acres land (prime location in the city) to the govt. and the building still stands.

Have you sent the letter to CP, Delhi already or are you contemplating to send it ?

If it the latter, maybe you should first speak to DSRA and seek their views before filing a 'complaint'... I could help you arrange a meeting, if you like ! The Secretary is out of station for a few days though...

In my view you would be doing a great disservice to the shooters of Delhi, including school children and budding shooters who look upon DSRA to promote their interests and hold competitions etc.; by unnecessarily creating a controversy with DSRA. Think about it...

Nothing except that National Emblem has not one or two but pictures of four animals in it. Instead they should file a case against the government of India for using "pictures of animals" as State Emblem or at the best go and phyisically destroy the ashoka pillar :mrgreen:

Nothing wrong with loving animals, there are plenty of members on this website including myself who are animal lovers but within reasonable limits. But the problem commences when some people under the cover and excuse of "animal rights" start doing unreasonable things and want to take away the inalienable natural, human and fundamental rights of fellow humans. I ask such "animal lovers" do they also love and allow mosquitoes, cockroaches, insects, rats and all kinds of pests to flourish in their homes and surroundings? or such animals not "animals"?

How about these self declared "animal lovers" reading 'Mum, the bear is eating me!' Just had a look at their website.
Firstly a noble cause. Not only procting wildlife but protecting 'international' wildlife. Also against animal cruelty, battery farmed meat etc. I might not fully agree with people opposing vivisection but i respect others opinion and also wish we had pragmatic alternatives. I do heartily applaud the statements against poaching.

They even state (in bold):

Poaching is one of the primary causes of the decrease and extinction of some wild species. It’s aim is often the capture and killing of rare animals, to put it in the illegal market or to show them as a trophy.

They later state:

Poaching is a 5 millions Euro businessTo that we can add the illegal actions done by the hunters: even if their activity is legal, they often don’t hesitate to shoot to a rare and protected species.

What is 'illegal' hunting and how is it different to poaching? Using words 'often' is very misleading. Though no one can account for the action of every hunter throughout the world, using the word 'often' implies that more the hunters, more often than not, dont hesitate to shoot protected species :!:
I would like to state that as an official member of hunting clubs, official hunter with qualifications, i find this amounts to slander. I have hunter friends over 5 continents and have hunted in 3 and in a few countries and one only needs to go out with them and see how the hunting seasons are adhered to and how the protected species are protected. Most of the pics in the hunting section are not even about hunting. I wish to find if there is anything i can do legally to make them remove/change/modify this statement.

Olly, this is exactly these kind of people want, to create sensation, to be given unnecessary importance and be in the news. Please do not give unnecessary importance to such people, let them go ahead and file complaints. Please inform the DSRA to read my first reply to this thread and appraise the Delhi Police Commissioner of the same, as there seems nothing much in this case except publicity seeking.

Agreed. Just talking is one thing and proceeding on baseless grounds another. I think he has received a lot of publicity here and the matter is not worth more.

I was thinking if it could be amicably settled.... the Secretary is a lawyer himself and so is his family !!
