Foriegn Post refusing to deliver arms - Please Help .
As per the DGFT noitfication states that "import of .177 guns and air pistols will be free for shooters registered with rifle clubs of Districts/State / National Rifle association" . it does not state any where that the rifle club should be affiliaated to the NRAI . But someone from the Kolkatta Foriegn Post called me up from a cell no. and is refusing me that my diana rifle would not be cleared of customs as the club membership i have provided is not associated to NRAI. Even it may be confiscated . I told him him that the exim policy notification does not mention that anywhere . On this he said that the exim policy which i am saying is changed now . Please help me with this any person with some legal knowledge . i wont let this down without a fight . i personally feel the person was trying to make easy bucks from me because i dont agree that any government person would make a official call from a cell no . PLEASE GUIDE ME SOMEONE

Ask the so called government person to show the latest exim policy of which he is speaking about or ask him to read the latest policy. If you knew his details then inform him that you'll not leave this issue and you'll drag him to the court. AFAIK all the rifle clubs of district/state will be registered and it is not mandatory that they must be affiliated to the NRAI.

do what they do, but you do it first, send them a show notice
or do an RTI,
chance are if you respond to the same person he will not show you the notice, as most customs do not show any notice and they want you to go by what they say.

don't go down without a fight, better still don't go down at all
if u live in Kolkatta then met that customs officers superior along with the relevant notifications xerox, membership cards etc, immediately,
tell him that the customs fellow called you from a cell phone and that is not the proper procedure,
he should have served you a notice with sufficient time to reply along with documents
and also he threated to confiscate it.
don't accuse him straight away but suggest to the superior that he might be expecting a bribe.
also consider the use of RTI Act if non of it not works (it costs just 10-20 Rs.)!!!!

or just take your doucments etc and go and meet the superior as pyroman said but do not say anything about the cell call, just say you believe that the item has arrived and you want it. and see what happens is the easy way to try first.

1. Do not get hassled on the issue. There has been no change in the exim policy / club membership rules as far as I know.
2. I was recently lucky to help someone when he gave me a call by chance for knowing the whereabouts of his consignment from US, a .177 Benjamin Marauder which was stuck up in the cargo warehouse at the Delhi airport due to silly ignorance of India Post people(Foreign Post Dept at Delhi Airport) who are still very much 'sarkari' in their approach. Since I work at the Delhi airport and both of us are members of IFG, it just took me 24 hours to get his consignment delivered to him in Gujrat. Right people at right places and lots of positive initiative as it almost used up my complete day to help him.
3. This guy seems to be lowly warehouse agent / screener who wants to make quick money at the cost of our scare for the system. Be stern and tell him that you are lodging a FIR for extortion/bribe call from his mobile number to get your legally valid transaction cleared, but since its West Bengal!!!!! nothing can be certain on politico legal front OR try getting your shipment routed thru Delhi for a more positive result.
4. Definitely don't give up or waste time in RTI, pass his number around for all of us to hound him by our calls. Let him taste DEMOCRACY without CORRUPTION.

I had a smiler experience at the Delhi cargo service.....got my gun held up there for close to 2 months...
be strong n if possible take all your documents to his higher ups.....
I scared them with the RTI Act ...'act'!

Just yesterday, I got my walkie talkie cleared from 13, K S Road Cal-1. Myself too they show caused, I had a long debate with the AC Customs sitting at the 1st floor and the Superintendent . Ultimately we debated on "Broadcasting" and the HS code. They shown me precedences, that all earlier consignments of similar nature were never released. I replied, precedence do not prove, what you did were all correct, you are requested to apply your brain. They agreed, I got the goods.
It's not easy, but you have to go by the book (HS) and I ask them the copy of show cause. Also get photocopy of order passed from Superintendent. Do not send any one, and do not panic. You have not done any wrong. Still fear ? pm me.
