Allahabad High Court critical of strict gun licencing policy

The Allahabad High Court recently questioned the arbitrary denial of firearm licences by the State. In a judgement rendered in Pawan Kumar Jha v. State of U.P., 2011 (99) AIC 15 (Sum) (Alld. H.C.), the Court stated that the State should have only one criterion to refuse the grant of a licence : the pendency of some criminal case against the applicant.

The Court then went on to hold that, “Licence is normally to be granted unless there is something adverse. If there is neither anything good nor bad against a person, then the licence must be granted otherwise a tendency to keep unlicensed fire arms will grow”.

Let's see if this judgement is challenged by the State of UP.

I don't think there is anything left to be challenged. There have been many orders from courts in favour of gun ownership. Courts have already held applying for an arms license is a citizens right. Arms Act 1959 is a regulatory law to regulate the fundamental right of RKBA guaranteed under Articles 19 and 21 of Constitution of India. It is the morass of bureaucracy that has subverted this fundamental and human right of citizens.

I wish we could challenge :deadhorse: the people who r not recommending licences in court.
