Hello all..
No one has ever ended up with a conclusion about blank guns. So i decided to purchase one in an online store. But before proceeding i would like to ask our members to answer a few arguments in point wise. I'm aware that i have to answer the customs if the package has been seized. Please answer them with reference from any arms act,customs act etc... Some thing which is from the constitution.
1. Is blank pistol a fire arm? with ref
2. Should i pay the import duty for it? with ref
3. Is it written in any act that bringing or importing blank gun is prohibited? with ref
Any supporting arguments that prove blank pistol can be imported are welcome..

I cannot answer your questions with supporting documents but yes, u can very well import a blank firer and it is not considered a firearm as it is incapable of firing a projectile at all. Several friends have imported them, if u need any help, let me know.

As per Arms Act 1959, blank pistol is neither an arm or firearm because it cannot be used for offense or defense, neither it is designed to discharge a projectile of any kind.1. Is blank pistol a fire arm? with ref
INDIAN ARMS ACT 1959 CHAPTER I PRELIMINARY
2. Definitions and interpretation
(c) "arms" means articles of any description designed or adapted as weapons for offence or defense, and includes firearms, sharp -edged and other deadly weapons, and parts of, and machinery for manufacturing, arms, but does not include articles designed solely for domestic or agricultural uses such as a lathi or an ordinary walking stick and weapons incapable of being used otherwise than as toys or of being converted into serviceable weapons;
(e) "firearms" means arms of any description designed or adapted to discharge a projectile or projectiles of any kind by the action of any explosive or other forms of energy, and includes---
(i) artillery, hand-grenades, riot-pistols or weapons of any kind designed or adapted for the discharge of any noxious liquid, gas or other such thing,
(ii) accessories for any such firearm designed or adapted to diminish the noise or flash caused by the firing thereof,
(iii) parts of, and machinery for manufacturing, fire-arms, and
(iv) carriages, platforms and appliances for mounting, transporting and serving artillery;
CHAPTER VI MISCELLANEOUS
45. Act not to apply in certain cases.
(c) any weapon of an obsolete pattern or of antiquarian value or in disrepair which is not capable of being used as a Firearm either or without repair;
(d) the acquisition, possession or carrying by a person of minor parts of arms or ammunition which are not intended to be used alongwith complementary parts acquired or possessed by that or any other person.
If duty has been prescribed by customs rules and regulations, you will have to pay the applicable duty. If you do not want to pay the duty, then prepare yourself to fight it in court.2. Should i pay the import duty for it? with ref
I have no idea. To me it does not make any sense to prohibit importation of blank firing guns. Government derives its powers from Arms Act 1959 to regulate arms and firearms. If blank gun is neither an arm or a firearm, then from which act of parliament is the government deriving its power to prohibit importation of blank guns?3.
