45 days sale notice

5. Licence for manufacture, sale, etc., of arms and ammunition
No person shall---

(a) manufacture, sell, transfer, convert, repair, test or prove, or

(b) expose or offer for sale or transfer or have in his possession for sale, transfer, conversion, repair, test or proof,

any firearm or any other arms of such class or description as may be prescribed or any ammunition, unless he holds in this behalf a licence issued in accordance with the provisions of this behalf a licence issued in accordance with the provisions of this Act and the rules made thereunder:

Provided that a person may, without holding a licence in this behalf, sell or transfer any arms or ammunition which he lawfully possesses for his own private use to another person who is entitled by virtue of this Act or any other law for the time being in force to have, or is not prohibited by this Act or such other law from having, in his possession, such arms or ammunition; but the person who has sold or transferred any firearm or ammunition in respect of which a licence is required under section 3 or any arms in respect of which a licence is required under section 4, shall, immediately after the sale or transfer, inform in writing the district magistrate having jurisdiction or the officer in charge of the nearest police station, of such sale or transfer and the name and address of the other provision to whom the firearm, ammunition or other arms has or have been sold or transferred.

once one has informed the LA of intention to sale, then wait 45 days.
what if the person one has agreed to sell to (their details given in the 45 days notice to LA) the deal does not come of and you have a anther buyer. in such a case does one have to give a fresh 45 days notice to sale?

any thoughts on this?

which ever is COMPLICATED and TIME CONSUMING is applicable.yes nother 45's is must.

One of my friend had applied for sale /purchase permission , unique type of query is asked by DM.
He wants relevent section in arms act which support purchase as 45 - DAYS SALE NOTICE(Under Chapter II, Sec 5 (2)) only supports sale as per his perception.
This is something funny and frustating ,feedback from forum is requested...

Nag the sale permission reads,"That i now intend to sell this weapon/ammunition to M/s"-----------------------,in case of an Arms Dealer and Mr----------,in case of a person,which has to mention his Name, AL no,and a photocopy of the buyers license is to be submitted.So if the deal falls through you have to apply for a fresh permission,this is where our friendly Arms Dealer comes into play,and that being the reason they will charge from 5 Ks to whatever for the services rendered. :cheers: and that is + taxes

no law is straight in our beloved country. if a terrorist 26/11 mumbai can survive, why not an ordinary criminal?there are too many holes in our law and it affects only the law abiding citizens,criminals flourish and will,if a MAN WITH SOME GUTS AND RESPONSIBILITY TAKES OVER things might change.jai hind
