Do airguns now require a license?

umm...this is my first post here, and im v v sad that ill have to burst a bubble here, and be the party pooper, but as OF THE DELHI HIGH COURT JUDGMENT that i will attach, IT IS NOW ILLEGAL TO POSSES AN AIR RIFLE EVEN AN AIR GUN WITHOUT LICENSE...since 2002, THAT GSR 991 SCHEDULE II, ITEM 1(3) EXEMPTION GIVEN IN 1962 BY THE central govt HAS BEEN QUASHED BY THE DELHI HIGH COURT :_(( , SO EFFECTIVELY, NOW, AIR RIFLE IS ON THE SAME LEVEL WITH OTHER "LETHAL" ARMS AND HENCE THE LEGAL LIABILITY IN TERMS OF JAIL TIME, BE CAREFUL MAN, im so sad after i got hold of this, cuz i owned an air rifle too, and this is depressing, they have officially rendered men a napunsak after this quashing... effectively, u will have to go through the same toil of getting a license for an npb weapon with all the plethora of red tape-ism and paperwork and delays....ASIDE FROM this link, ill also post a link from the delhi police's website, which wlll confirm it from the "horse's mouth", so to speak , ....but remember when i do this, im choking inside....cuz i also came to know this recently...


PS: read the 2ND LAST page, 2nd last para, if u dont want to read the entire sad story of how a wildlife "junkie " organisation made it happen....the website link is also here for those who dont wanna download the attachment....:

also plz tell whether this ruling applies in delhi only, or all india...i dont know that...


on another note, if ANYONE knows another lawyer who can see any developments on this, ie after this 2002 court decision, but anything...anything, even a morsel of hope...plz reply... :|

ps: i urge u to forward this to ALL air rifle owners, so that they dont live in ignorance..... lol dont want a day where u brandish an air rifle in front of everyone in a party, and one of them is a cop :P who knows stuff u dont....

Is there a new ruling on this, coz AFAIK, there is a stay on this judgment of 2002 since some time and that was the last we heard.

man i dont think there is a new ruling, if u know, produce it here man, and chances are there isnt, bcoz of what's on delhi police website and even tamil nadu police website, and all this is current.......chek it out man....

2002 is current? I wonder how? and why has it taken them 8 years and still you can buy them off the shelf? There was a similar discussion some time back on this forum itself where the details of the stay have been mentioned. I will search and post it, if some other members have it ready, please do post.

i meant the info the delhi police and tn websites have posted about license fees regarding air rifles and guns is current(i mean u can open those links now and see, the consequences of 2002 judgment r seen :cry: ), that is just the reflection of the fact, that there was probably no stay in the 2002 judgment...

i don't understand the details of law, but i think courts cant change laws, at least the high court cant, they can only act according to law on a case to case basis, and if they feel the need to licence air gun ownership, they can recommend it to the government who can act or not act accordingly.

If you go to a dealer to buy ammunition or fire arms, he asks for your license. How come he does'nt ask for your license when you go to buy an airgun???

All IFGians from Chennai/Tamilnadu, please share your updates regarding the license issue for Air rifle/gun. i am bit confused and worried about the fate of air rifle :cry:

there's no need to panic.airguns are way away from licence.how many of indian shooter's in commonwealth had licence?i also beleive that you can't pose this law now.so no stress!enjoy shooting.

I am very sure that NO license is required for purchase or possession of Air Weapons :D (Except air weapons failing the deal wood test).

The fee for the license of air weapons as mentioned on the website of Delhi Police is for air weapons that have failed the deal wood test.

The deal wood test is a pretty primitive test to assess the power of weapons where a shot is fired from a rest at a piece of deal wood that is 1" thick, and the pellet should not penetrate this piece of wood, or it would require a license.

it would be a HUGE relief, if all u say is true, but these state police websites should be a tad more descriptive about the licensing of only CERTAIN kind of air rifles, anyone would think that all of them are under the scanner by the looks of it....
the judgment link is extremely helpful,(that stay order), but we dont want a situation where the delhi police arrests u and u have to battle this out in court, some more links of assurance would be awesome, bcoz we are talking about a non bailable jailtime if there is no "meeting of the minds" between the del police and the courts regarding this stay order(bcoz that would lead to a very bad day of clarifications)....
i think ill just pick up the phone and ask the licensing office whether what they've posted on their websites applies to all air rifles or only those which fail the wood test....

I suggest you please go through the entire website, especially the legal section and airguns section before posting anything here.
A lot of people here have taken pains to get and publish accurate information here so please do not insult the hard work and intelligence of these people.
No one can help you if you can't believe experts in there respective fields here.
