query about the transfer of license
hi
I am Gino K Jose from kerala. My grand father having a shot gun license and now because of his old age I want to transfer that license to my name or to my father's name. But the licensing authorities are are not saying that it is not allowed. What i can do for transferring this license

if you read the licence it will say non transferable. what you need to do is apply for a licences for you self or your fathers name. or get your grand father to get it endorsed for a retainer ship, for you or your father.

Yes nagarifle has said the correct thing. You or your father will have to apply for "grant of license". There is no provision for "Transfer of license" under Arms Act 1959. Arms licenses are usually granted for self defense, sport, crop protection and family heirloom. You have to choose under which option you want to go with. If you or your father is granted arms license under self defense then, on papers your grandfather will have to "sell" the firearm to you or your father.
The problem with retainer-ship is that, after the death of your grandfather, the retainer will have to apply for grant of arms license in order to retain the weapon.
When the license is granted under family heirloom, it is granted to the legal heir, subject to no objection by other legal heirs. Normally, the scope of legal heirs is extended to husband, wife, son & daughter. Grandson does not normally fall under legal heirs unless there are legal conditions to the contrary, by the virtue of which the grandson becomes the legal heir. Yes the son of your grandfather i.e your father can apply for "Grant of License" under family heirloom category. If the licensing authourities still decline, ask them the specific reason as to why they are declining? If they say that there is a letter from Ministry of Home Affairs. Then ask them to refer "iii) Grant of Licences under family heirloom" in that letter.
