Applying for a License

Hi,

I have applied for a arms license (12 bore) in mumbai in 2004 but it got rejected.after which i have done appeal to home ministry and i got a call from home department after 2 year during this years i was posted to Saudi Arabia office because of my migration i was not able to produce myself. Now my question is can i apply for a fresh license from my native state i.e Uttar Pradesh. this gun is inherited from my uncle.
please advice.

For rejection, licensing authourity has to give written reasons.
1) What were the reasons for rejection, written by Licensing Authourity?
2) Did you appeal to Home Ministry at Centre? If yes then why approached central Home Ministry instead of State Home Department?
3) What were the reasons you mentioned in the appeal?

BTW you can always apply for an arms license, wherever you are residing in India, there is no bar on applying for an arms license. Applying for arms license is your legal right. Self defense is your fundamental right guaranteed under Article 21 of Constitution. When you apply for firearm license for self defense, your legal right and constitutional right get closely inter related, hence license cannot be denied on any vague or flimsy grounds by any licensing authourity. In my opinion you may apply for arms license for self defense. Once you get the license, you can get the gun of your uncle endorsed on your license by the way of "sale" or whatever applicable legal procedure for same.

The reason the for rejection what authority mentioned was that your application is been rejected due to public safety.
i had done my appeal in state home department. the reason i mention in my appeal was that the decision taken by the licensing authority was not correct and it is our inherited gun.

In my opinion rejection of arms license to a law abiding citizen on grounds of "public safety" is a bogus and vague reason.

Even one of the Objectives of Arms Act 1959 states: "that weapons for self-defence are available for all citizens under license unless their antecedents or propensities do not entitle them for the privilege"

Above objective very clearly means that arms licenses are available to "all citizens" unless they are disqualified due to their antecedents or propensities. Hence feel free to apply for arms license for self defence, once you get the license, you the have option of either purchasing a brand new gun or "purchase" the gun of your uncle.

i have appplied for a shot gun license as heirdom in november. and i got the police, CO, DCRB and alive report cleared but now SP RA Steno is saying that he need to see me. as i am on my business trip i cant see him. is there any provision that i can ask aslaha babu to get my file from him as he is sitting on the file for more then 2 months.

Ascertain why does SP RA Steno want to "see" you? Can the purpose be served if your uncle or your family member meets him? Else meet him once you are back from your trip.

i have applied for a Shotgun license from Uttar pradesh and i have given my Mumbai address also. what type of report will the Uttar pradesh ask from mumbai? is it necessary that i have to be there at my house in mumbai? as i am currently out of india.

I think instead of giving two addresses, to keep the matters simple you could have given only one address. No it is not ncessessary for you to be always present inside your house but occupants of the house or the neighbours should be willing to tell the visting police officer that you indeed live there.

will the police come to verify or they just need report that i don't have any criminal case against me.

They are supposed to look for criminal records on you. But nothing prevents them from "verifying" your address by personally visiting the address mentioned by you.
