Hi shooters,

I'm from Punjab & have been reading in newspapers/media about Govt. orders asking Licensed weapons holders to deposit their arms with the police or arms dealers due to the coming elections.

Now, I want to know whether its mandatory to deposit arms?
What if someone doesn't deposit & keeps it with him/her or in locker?
What does the law say?

I asked a policeman & he said that one can keep weapon at home but if caught roaming with it, legal process shall start. I did not believe him fully due to lack of knowledge among policemen.

no it is not mendatory however at certain places or people with criminal cases has to deposit .Dc orders the local police to collect the weapons & deposit either in police station or gun houses but they will not say anything after theft of Hoshiarpur

Yes, Hoshiarpur incident was shocking, I used to deposit arms with dealers earlier, now I shall deposit only if mandatory!

The thread you are mentioning is a little diff. in content. It says how to get exemption!

First I posted my query in that thread, but due to no responses for 2 days, thought of starting a new one.

You don't need to deposit them unless you are served a notice (by the competent authority) to do so. In which case, you can either:

a) File an appeal with the authority asking you to make the deposit, you will need to appear in person to plead your case. If your appeal is rejected you can further appeal in a court of law, ask your lawyer to cite the Hon'able Allahbad high court's verdict as a precedent.

b) Deposit the arms with the police/ arms dealer

c) If you are eligible for exemption, file the application for exemption as described in the other thread.

Thanks Abhijeet, but what about the general notices which are put up in newspapers urging license holders to deposit arms? I've never heard that Govt./authorities serve notices to individuals, but I may be wrong!

What if I do not deposit my weapons after Govts. announcements in media, can they take any action against me?

I was going through the laws section in the forum regarding depositing arms, but nothing is mentioned about depositing arms during elections!

D.C/Majistrate in Jalandhar had ordered deposition of arms from licensed owners & the SHO's of respective areas formed teams to collect Arms. One such team came to us & we had to deposit Arms.
On asking why was this done, reply was, its Sahibs/officers orders & no notice/order was shown/served.

I read in another thread about local/high courts order clipping SHO's wings on collecting weapons, such orders should be instantly adopted uniformally by all the States/Nationally.

In UP there is a Allahabad High Court ruling wrt deposit of arms.....even then I know for a fact that in Western UP,folks are asked to deposit..and they do...guess the only way out in your case would be to become a member of NRAI.....

Abhijeet is right,if and when u are served a notice it is mandatory to deposit ur firearm/s with the local police station. I had been served a notice/summons to deposit my firearms which was duly done and will be with the police dept. till approx. 20/05/09 as the election code of conduct ends on the 16 th of this month.

@Olly, actually I was a little apprehensive in depositing weapon, as you never know, these people can change parts.

@Sanjay, local bureaucrats act as goons & think their order is supreme. No justification, notice, etc are given, its plain inspector raj!

@Happy, rules/laws are exploited by Govt. officials, they don't think its necessary to serve notice to citizens.
