Exemption certificate (Coorg)

Sir this is to bring to your notice that that I have obtained a exemption certificate from additional district magistrate which states that he party is exempted fro operation of the section 3 and 4 Indian arms act 1959. But the arms or ammunition carried by such persons herein exempted while travailing or residing outside the district of kodagu and shall not exceed one N.P. bore rifle with 100 rounds of ammunition for the same one smooth bore breech or muzzle loading gun with 500 cartridges or the equivalent or in lead shot and gunpowder .sir under a special provision I have obtained this exemption certificate. Now I like you to explain the pros and cons of the exemption certificate as out of my knowledge I can carry this gun in INDIA as this is a valid all India license. And I also request you explain me the limitation of my exemption certificate

Limitation-When traveling out of the district you can only carry only

i) ONE NP bore rifle with 100 cartridges and

ii)One smooth bore gun or muzzle loader with either 500 cartridges(if a breech loading shotgun) or the equivalent in lead shot and powder.

No firearms or ammunition other than these

The other limitation would be the ignorance of police men in the rest of the country about Kodavas being exempt from licensing requirement

Out of curiosity,does this exemption allow you to own a PB or a Prohibited firearm since it does not mention any limitation as to what you can possess while you are within your district?

as per ur queriey in regards to owning a PB is not permitted in exemption certificate however as u have said that it very few who knows about EC this becomes more of inconvience whe u need to explain it to babus howver do u agree that this is a valid all india permit as it doesnot say ani=ything about the jurisdriction

sir i need your advice in regard buying a DBBL i have my eyes set on KHURMI its lite and the the gruoping is in left which is very good as a matter of fact with cartridge of 01 there was 89 percent hit at about 40 yards however i need your sugestion as i carry my weapon twice in a week to my farm house an at will discharge about 6 to 8 rounds ina week your suggestion will help me make my mind

Yogesh,

It does appear that your exemption certificate entitles you to bear the firearms and ammo that you can carry out of your district,through out the territory of India.

Does the exemption certificate specifically mention 'allowed to own only NPB firearms' or words to that effect?

Re.Khurmi,my suggestion would be to instead look for a well maintained IOF 12 ga.

If I were you,I would like to obtain the notification exempting Kodavas for the requirement of obtaining a license for owning and carrying firearms.Write to Indian Ministry of Home under RTI for a copy of the notification.They generally take some time but do respond.You may find that you enjoy greater rights than the local babus would lead you to believe.

i thank you for your timely reply, in regard to the notification on my exemtion certificate i request you to give me more information how to go about getting the notification for the same, as we in coorg need to submit a copy of jamma i.e paper of ancestoral land as this paper is proof that iam a coorgie a few years back we didnot even need a exemption certificate for same as time changes the PnP also changes so the concerned dept came up with exemtion certificate that only coorgies get this certificate as we the kodava consider weapons as our god i.e the only reason why a gun plays a very important role in our kodava culture. sir please advice me how i can obtain the notification for same,

The address is also given there.You can either address it as "For PIO dealing with Arms Act 1959 and allied rules" or you can find out the PIO's name from the list of PIO's given on the site.The information that you require is to be given on a separate sheet attached to the application form along with a draft of Rs.10 payable at New Delhi in favour of the Ministry of Home Affairs ,Government of India.Get the draft made from any nationalized bank.The private banks are too expensive.

If I were you this is what I would ask for
INFORMATION SOUGHT

1.Copy of the notification granting exemption to Kodavas from the provisions of the Arms Act 1959 and Arms Rules 1962.

2.Whether this exemption extends only to firearms of category III of Schedule I of the Arms Rules 1962 or also extends to firearms of Category I(b)and I(c) of the Arms Rules 1962

3.Whether the exemption accorded to a Kodava is of an All India nature or extends only to the boundaries District in which he/she ordinarily resides.

4.Whether there is a limitation to the amount of arms and/or ammunition that a Kodava is entitled to carry out of the district in which he/she ordinarily resides.

5.Whether this exemption granted can be circumscribed/limited by a State govt order/notification
