Is threat to life necessary for a gun licence?

Dear Comrades,

I came across the following article in today's edition of DNA Mumbai. Thought will share it with you guys!

What I am surprised with is the fact that inspite of Section 14, why is it so difficult to get licence for SD? I know that majority of the Babus dont know the Arms Act.

But isnt this a goldmine? If this is the case, then on what grounds can the licence be rejected? Will the authorities prove that a person is either insane or a psycho & thus cannot be granted licence for SD.

Rup,

You are right about sec 14 but every babu be it the DCP or DM interpretes the application in his own way.i know some cases where my relatives who were into well off business were issued a license and employees were refused the same by the same DM.does it mean that dacoits or burglars target only business men??Certainly not.The babus are left free to take their own decisions irrespective of what is there on paper.

You are absolutely correct in that it is a "goldmine". There is a procedure to go to court if in fact the license was refused on frivolous grounds. The onus of proof actually lies with the police to prove that the applicant is in some way disqualified.
The usual refusal letter will not carry the reason for refusal, only the statement of refusal. This can be used in court and as proven in the article it is in favour of gun owners. The Law is clear, the interpretation however varies with individual officers and is left to their discretion.(It is this discretion that must be removed from them and a equal/uniform law must be passed.

How ever the way things run in Indian Beureacracy(spelling?) the application can be derailed even before it gets to the right table for approval.
