Indians For Guns

My Dad owned a Semi Automatic Pistol .22 Bore beretta, made in 1973 since mid 1970's.

Unfortunately he passed away this year due to a Heart Attack.

Is there any way i can transfer the gun to my name.

The Gun has been deposited to the state treasury as i had no idea what i need to do to get a license and keep the gun as i have grown up seeing him care for the gun and would really like to keep it in the family.

Another issue in this case is that i am an NRI living in USA.

Please help otherwise i will have to sell the gun away, i dont even know the price of the gun and as it is the money is not important to me but the gun REALLY is...

no reason why you can not apply for arms license in .22 pistol. what you need to do is fill in application forms etc and submit them to local office with Indian id proof etc. the issuing authority may send someone down to interview you.

as for the price which depends on conditions you could be looking at anything from 3L +

If you are living in USA, I am afraid you cannot get the pistol transferred to your name or have it exported to US. Only guns for which no ammunition is being made in India can be exported.Also, please search the forum and this topic is well covered.

Do you have any other siblings staying in India, who could get the permit and keep the gun?
I dont think you could get it out of India to keep with you in US.
Or ... if you are planning to come back or keep visiting India, maybe some thing can be done - You could get a permit and keep the gun in India under your name. Abhijeet (Mundaire) is the best person to answer this...

Well i am not much aware about MH but in UP for death case you have to apply for a fresh Lic. all the formalities will be same but during the interview with the Licensing authority you may get some priority in case of death /transfer of the handgun.But at present you are not in India you cannot apply for the Lic.

I am planning to come to india in Jan and will be there only for about 3 weeks... But will try and see, the problem is finding someone in Bombay who can help me with this scenario. Also the gun is in Gujarat where my dad used to live and so am confused, earlier i thought i will apply for a license for my mom but then i was told its too much of a hastle as she will have to surrender the gun during elections, etc...

I woule be more than willing to pay fees if any one can direct me to some professional who can help me with this...

Also i will be moving back to India in a few years... so if there is any temperory solution for a few years that would also work...

Temporary solution would be to get it transferred to any family member who resides in India OR to leave it in an armoury till you get back.

my 2 cents :before depositing in an armoury ask them the legal period within which you can reclaim your gun, if you are depositing with an arms dealer the gun can be reclaimed within 1 yr or it is confiscated after 1 yr.

The only professional whom you should be paying or who can help,if at all, you is a lawyer. So,please save yourself some money. Some good advice above.

One word of caution. The govt. armouries are notoriously famous for having the parts removed and sold to local Arms dealers. That's why they insist on writing "old and used and as is condition" before issuing the deposit certificate. I have seen this happen many times. Also, if some IAS guy takes a liking towards it, then hard luck chum....bid goodbye to the handgun. I insist you deposit the handgun with a reliable Gun Dealer instead. They charge a nominal fee on monthly basis and issue a certificate as well. Another advantage being that a family member can periodically go and inspect the handgun which is not possible with the govt. armoury. All the best.

An local armory, especially one that is known, is probably the best option

Is this a new rule ???? I never heard it before that the shop will Confisticated after one year???

You can deposit it at the shop for as long as u wish,
