legal possibility for arms import?
Dear Moderators and Friends
Indian Arms law admits civilians to have np bore arms for the personal safety and shooting sports ,due to lack of standard & reliable arms by iof and import restriction shooters are in dark room with a candle light .
Is there is any legal way/procedures to file case in supreme court to release the exim policy restriction for np bore arms passed by finance home . moreever we have right to keeps np bore arms for personal safety and shooting sports .
Can ifg join hands to solve the exim policy ?

all i know is that every layer say ur case is a good one and u should win. layers are needed for this but one has to know a good one.
in delhi supreme court lawyer would cost as much as 1lac.

in my earlier posts the decesioj to ban are executive instructions not having any test of legislation so they can be challenged in court,
someone pointed out in the previos post that no test of legislation is required as the parliament passes the budget which in turn quotes the restrictions.
but this is an order of the home department , the finance ministry has nothing to do about it if permitted by home ministry the finance ministry charges some custom duty on the guns imported by the sports person !,
i suggest we hire a good lawyer and take his opinion

so in reality i just can not import arms.
now what it looks like to me is that there is not one ministry, one would have to tackle but two or three. the finance ministry, home ministry, imports etc, if one does not allow then it would not matte what the other ministry allow would i be right in these?
if i am not wrong its seems to be common knowledge that since 1986 arms import are banned unless u have import licence, which is hard and impossible to get unless u are top 25 shooters.casual shooter";p="46162 wrote:

One of my friend is professional lawer and he is willing to take this 1986 arms ban issue in state highcourt .
He is asking for the copy of the 1986 arms import ban act details for further move.

AFAIK there is no notification as such, neither is there any act of parliament covering this. As has been stated before it was done by simply placing arms & ammuntion on the negative import list in the EXIM (export & import) policy which is a part of the union budget tabled before the parliament every year.striker";p="47729 wrote: Friend and addicts

So (in theory) imports can be reopened if the government simply removes these items from the negative list, as has been done in the case of .177 cal airguns.

Challenging the Arms Import Ban
Has anybody ever challenged the Arms Import Ban ? If yes with what result? If no, will the fellow IFG members consider taking some action on this?

Please we would love to see this anarchy coming to an end, we could protest that the domestic gun market is way to high and in order to protect the rights of the buyer the government has to allow import of firearms.
Also the ban on import of firearms also violated / hinders the right to carry and procure a gun, the ban is causing many people not to even consider buying a gun because of the high prevalent rates.
