Detained for keeping a knife, please reply

Hi,
I live in Hyderabad. Today afternoon, few friends and I went for fishing. My friend carried a folding knife with a blade of < 3 inches. He has been cought by cops and detained at PS. It appears they have lodged an FIR. They are not letting him meet us or talk to us. Is it fair to arrest someone just for carrying a knife? He was able to justify that he carried it for fishing and they called me and confirmed the same. Please reply and let us know what can be done here.

take a look at the arms act. which say that knife has to be 9inch or over.
the police may have arrested him but they will have to file a charge sheet. FIR is not a charge sheet. when the police lawer see that he will have to advice the police to drop the case as against the law. unless you boys were up to something else which the police think is wrongdoing.

if you feel strongly against that the police have done,then seek a lawer, and sue of illegal imprisonment.

Get in touch with a criminal lawyer and ask him to meet the cops with a copy of the relevant section of the Arms Act. Personally I don't think the cops arrested your friend for carrying a 3 inch folding knife. No policeman would be fool enough to do that. There could be something more to what you and your friend may not be aware of. Please inquire.

His father has checked with a lawyer whom we could not get in touch with. Now they say he would be imprisoned for another 15 days. This is outrageous but can't seem to do anything.

What frustrates me more is all the lawyers are saying the knife is illegal. There is nothing in the knife which makes it illegal that I know of.

The problem is I got in an argument with his dad so can't be directly involved. They considered my approach to be incorrect and are in no mood to challenge the cops. They are just looking to get done with this.

I believe that you have not mentioned all the details. Was your friend with you when the cops caught him, or was he held in a separate event after you had parted with him?

Either way you have said nothing about the circumstances under which he was held by the police. How would anyone on an internet forum be able to help upon simply hearing that someone with a knife was held by police? If there is something that you know but do not wish to reveal, please do not reveal it, but do not expect any help either.

Could it be because.....
1. Was the person openly displaying its naked blade...
2. Was he brandishing it for some unknown reason....
3. Was he arguing with some one at that time while holding the blade....
4. Was there a sense of bravado shown when the Cops questioned him about the knife....
5. Was he 'inebriated' when the Cops stopped him....
6. Did he break a traffic signal & speed through....

It appears there are a lot of 'slips' between the proverbial cup and the lip...
Wonder what the truth is or is someone hiding it?

Well no. There is no slip in my version. Hr dropped me at my home, picked another friend from my building and went towards market. The cops were on checking with DSP on sight. They were not near the checkpoint but a little far. 2 cops came on a bike and asked him to come to the checkpoint. They said it would only take a minute and they will let them go. Once they took him there, they checked him in front of dsp and found the knife. They checked the other friend too but could not find anything on him so they asked him to leave and arrested my friend. That's it. Some people told there was a tip for attack on dsp that's why they were checking people. He is an employee of a reputed firm and has never been questioned or arrested in past.
