The answer to these three questions should not make a difference! Read Section 13 & 14 of the Arms act.

But anyway

1. Read section 14.2
2. I believe it would be illegal for them to even ask this! Are you trying to connect the dots between you and your family members income?
3. As long as you are not the accused...

14. Refusal of licences.-
(1) Notwithstanding anything in section 13, the licensing authority shall refuse to grant--
(a) a licence under section 3, section 4 or section 5 where such licence is required in respect of any prohibited arms or prohibited ammunition;
(b) a licence in any other case under Chapter II,--
(i) where such licence is required by a person whom the licensing authority has reason to believe--
(1) to be prohibited by this Act or by any other law for the time being in force from acquiring, having in his possession or carrying any arms or ammunition, or
(2) to be of unsound mind, or
(3) to be for any reason unfit for a licence under this Act; or
(ii) where the licensing authority deems it necessary for the security of the public peace or for public safety to refuse to grant such licence.
(2) The licensing authority shall not refuse to grant any licence to any person merely on the ground that such person does not own or possess sufficient
property.

(3) Where the licensing authority refuses to grant a licence to any person it shall record in writing the reasons for such refusal and furnish to that person on demand a brief statement of the same unless in any case the licensing authority is of the opinion that it will not be in the public interest to furnish such statement.

if you are not disqualified by sec 14 you have 100% chance to be given a license for self defense. If your application is rejected you can go to court on the basis of this.Section 13.3 also ensures grant of license for self defense.

Dear Karmveer:

1. Property has got nothing to do with the requirement of a gun licence.

2. HUF is only a legal term for availing certain benefits provided by customs as well as law. Any
member of HUF does not enjoy any special right individually as HUF member THOUGH enjoy his
individual rights as being a citizen. HENCE HUF itself or its members being such members alone
ARE NOT entitled for gun licence.

3. NO chance just being an eye witness to a murder UNLESS can prove threat to life IF APPLYING
ONLY ON SUCH BASIS.

With Regards

Karmveer,

When i applied for a license I met a gentlemen who had applied on the grounds same as the 3rd point mentioned by you. There were 2 ppl eyewitness to a murder. The other witness had been murdered and now he was the only one left. In his own words he had a spent a significant amount of time arguing his case with the licensing ACP and had submitted documentation to support his claim. However, the license application was rejected.

He then appealed to the appellate authority (LG of Delhi in this case) who granted him a license for one year. The entire episode and story is not compliant with the Arms Act- proving threat et al.

Now is this a one off or rule with Licensing is anybody's guess. I wish I could assign a % to it. In my view if you are ready to fight for your right and not be discouraged by the time, effort and agony you have to go through to get a license there is a 100% chance you'll get it - it is the law! If one doesn't want to go through the pain then no matter what the reason- the chances are negligible.

Regards,
SS

Karmveer,

I would suggest you employ a lawyer to draft your application. While we have our experiences with dealing with the licensing units of our states, we might not be best positioned to completely translate your situation into an application. Needless to this, this is my suggestion- unless someone here has that expertise.
