I am life member of NRAI and having 3 weapons, I am in distric Barnala Punjab. Yesterday I asked SHO and showed him election commission notification that NRAI members are exempted from depositing arms but he did not agree and in last I had to deposit one of my weapon in police station. What can be done against such highhandedness of police?

Whether you have a membership of a Rifle association or not, the condition put forward by the Election Commission is that only those licensees who have had a past record of having disrupted the election process or committed such other crimes that may disrupt the democratic process etc. are to be made to deposit their arms. The Police however are issuing blanket orders to include all licensees irrespective of the conditions placed forward by the Election commission to deposit firearms during elections under Section 21of the Arms Act.
Instead of fighting this lack of application of mind and discretion by the Police,the NRAI instead has got an exemption from the Election Commission for its members. Now just showing the above mentioned exemption to the SHO has not been sufficient, I have had to approach the DCP to get an exemption issued, by showing them the Election Commission exemption in 2009. This year, I had to show the Election Commission exemption as well as rule that it is applicable to all elections, and the previous exemption issued by the previous DCP in 2009 to the current DCP who is "very strict" .
IMHO it means that even if you are a member of the NRAI, every time there is an election you will have to go to the Licensing Authority, tell them that there exists an exemption for NRAI members, and that now an exemption by the Police be granted so that the SHO or other officer may not bother them . At least that is how it has been for me so far.

always give a letter as well explaining the situation and ask them to respond to the letter in writing. no bug*3r worth his salt will. aslo write to the election commision explaining that the local copse etc are not enforceing its directives and making up their own in the name of the election commission's,
