PURCHASE OF CARTRIDGE

I have been told by an Arms Dealer that an Arms License Holder with a particular State Validity CAN purchase cartidgres from anywhere in India without any specific permission from any Authority

i.e. to say Even if One is having an Arms Licence having Mumbai Validity only, though he cannot take his arms outside Mumbai without necessary paperwork

BUT, he can purchase cartridges for his weapon from either Delhi, UP, AP, Kerala and likewise from any Arms Dealer in India WITHOUT seeking any permission from any Govt. Authority.


IS IT THE TRUE LEGAL POSITION or have I been misled?

i believe you have been misled. unless one has authority one can not. As arms license is only valid in state/area mentioned in it.

I doubt what arms dealers have said to you unless the matter is proven otherwise, with proper reference to relevant provisions of law. Please refer Section 3 of Arms Act 1959. It clearly says no person can acquire, possess or carry any firearm or ammunition without license for same. Your license does not exist outside the area validity of license. Please ask those arms dealers to tell you the proper provisions of law that allow you to possess or carry ammunition outside the area validity of license and share the same here.

BUT what about the actual purchase by me? It cannot be illegal as entry has been made on licence.

Dear Sainikji,

I have double checked with Arms department and you cannot purchase cartridges from another state where ur licence is not valid. Even dealer will not give you cartridges. If any dealer is giving you the cartridges then he is not doing that legally.

Purchase of cartridge with letter of authorisation

Is it possible for a person (who is not a retainer) to buy cartridge with my license on behalf of me with an authorization letter?.Anybody please explain the legality of the purchase in the absence of the licensee.

Please see if there is such a provision for ammunition in Arms Act or its Rules. Otherwise avoid doing such thing.

I had a discussion with a dealer in Chennai, who was willing to ship me ammo provided that I give him my original All India license, in which he would make an "ammunition purchase entry" and ship the ammo and license back to me by GATI. Apparently the transportation of the consignment is covered by my license. Now he says if mine was not an All India license, then he would need to get permission to send ammo to me.
Makes sense as the law stands, if you ask me.

AFAIK, an authorisation letter from an arms licensee issued to even a "non- retainer", carrying his identity details and typically his attested signature, can be used to purchase ammo on behalf of that licensee, for the use of that licensee under his license and for no other purpose.
