Good find Syed! :)

The Government probably saw this coming, hence had tabled an amendment bill in the winter session... see page two of http://www.indiansforguns.com/viewtopic ... 1&start=15

Cheers!

Just glad to know that the courts are fair even though the governments are not.
I wonder, what will happen now? Will this section be removed and amended from the main act?

As per the above verdict, the government need not even bother amending the relevant section of the Arms Act, as the Supreme Court has ruled it as being unconstitutional and therefore invalid.

This amendment is not at all related to legal or illegal prohibited bore gun owners. Prohibited bore and prohibited arms are two different and unrelated concepts. This amendment is related to amending the Section 27(3) of Arms Act 1959. With help of this amendment, the words "shall be punishable with death", the words "shall be punishable with death or imprisonment for life and shall also be liable to fine" are to be substituted.

BTW in the Arms Act 1959, it is not only Section 27(3) that is unconstitutional, there are many more sections that are unconstitutional and repugnant to the concept of right and reason. I am hopeful that some day the judiciary of our country has the courage and wisdom to see and say this.

Nope it also applies to someone who perchance had some old LGs/ SGs lying at home and had a negligent discharge/ accidental discharge which resulted in someone's death. In which case that person would have been eligible for an automatic death penalty. After all SG's/ LG's are listed as prohibited ammunition (since the 1980's).
