HELLO TO ALL
PLEASE ALLOW TO INTRODUCE MY SELF
ASIF, I AM NEW ON INDIAN FOR GUNS WOULD APPRECIATED DEEPLY IF ANY ONE CAN SHOW SOME LIGHT ON HOW TO TRANSFER A RIFLE/REVOLVER LICENCE FROM YOUR FATHER TO YOUR NAME ,

WHAT WOULD BE THE BEST WAY FORWARD AND WHAT REASONS SHOULD BE REQUESTED FOR A TRANSFER

WHAT ARE THE REQUIREMENT FOR A TRANSFER

WHAT IF ONE'S FATHER HAS A ALL INDIA LICENCE WILL HIS SON WILL ALSO BE TRANSFER THE SAME OR WILL THERE BE A CHANGE IN THE TERRITORY

AND ROUGHLY HOW LONG THE WHOLE PROCESS TAKES AND WILL COST

A BRIEF INFORMATION WILL BE ANTICIPATED AND APPRECIATED

License cannot be transferred, instead the weapons on license can be transferred to you if you also have license. Hence apply for firearm license under family heirloom category. Once you get license follow the procedures to get the weapons transferred on to your license.

Please avoid using capital letters as it is considered equal to shouting on this board. Also please do not create duplicate copy of same thread in various sections, it is unnecessary and you may delete them.

thanks a lot for your reply I do apologise for the concern's you have raised as I am new on the site and was not aware of the site manners and procedure. will take care in future

could you please show some light on family heirloom category as I have never herd of it before it would be very kind and helpful of you if you can send a link or a article on it so that I can have bit study on it before application just to understand the pro and cons of it

No problem, no need to apologize. Arms licenses are usually issued for self defense, sport, crop protection and family heirloom. You have to choose under which option you want to go with. In arms license application there is question about "need for license", you can mention "family heirloom" as reason. When the license is issued under family heirloom, it is issued to the legal heir, subject to no objection by other legal heirs. Normally the scope of legal heirs is extended to husband, wife, son and daughter. For "family heirloom" you may refer to "iii) Grant of Licences under family heirloom" in the letter by Ministry of Home Affairs, sent to Home Secretaries of all States and Union Territories. thanks a lot mate I will go through the complete process and will apply accordingly as you know that in India things hardly go by paper rules everyone need to be fed before the next one in line I will try my best and seek your help as need as I have got a very sentimental value attach to my father weapon and don't want to lose them if god forbidden some thing happens to him I just want to treasure it and feel proud

It appears that you had written about your situation at http://indiansforguns.com/viewtopic.php?f=4&t=15316 that the Licensing Authority was sleeping on your file for seven months, then he had a dream that arms license is matter of "threat" or "no threat" and had rejected your application and now similarly the Appellate Authority is sleeping on your file for seven months.

And at http://indiansforguns.com/viewtopic.php?f=4&t=15380 you had expressed your desire to approach High Court.

If you want to make an attempt to try awaken the Appellate Authority, before approaching High Court, you may give an attempt by doing an RTI application. A sample RTI application is available here http://indiansforguns.com/viewtopic.php?f=4&t=10826 Besides this I do not think there is any other way than getting a writ from High Court directing the Licensing Authority to do its job as per law within the specified time in the writ.

Transfer of Arms License can be done on two conditions - a) When the original licencee is alive- 1. During his life-time, the licencee may transfer the arms licence to legal heirs by making an application in plain paper. 2. The person to whom licence is to be transferred shall apply on Form A. b) When the original licencee has expired- 1. Application shall be made in Form A. 2. No objection from the legal heirs, in the form of an affidavit sworn before a magistrate. 3. Two passport size photographs.
