They may not have it and I'll advise you to buy this from Mac1airgun as you'll need bulk fittings etc unless you plan to use Co2 cartridges. You'll need bulk fill tube+end cap, asa to npt adapter and a 12 or a 20 ounce paintball bottle.

BUT, the guys at the customs will not bother to argue with you... so 14% + it is... !!

I can understand if people give up against the arm-twisting methods of customs, but the effective rate of duty ( in whatever name ) applicable on import of air guns of 0.177 cal is ZERO. As per Dev’s and Olly’s information, customs is collecting CVD ( Countervailing Duty ) on air guns. But what is CVD ?

CVD is a type of duty applied at a rate on imported items, which is equal to the Excise Duty (now called CENVAT ) on its manufacture in India. For e.g. if item “A” is manufactured in India and 16% CENVAT is applicable, then on its import, CVD at 16% will be charged in addition to the basic duty. This is done to remove the cost advantage of imported items against domestic manufacture.

Currently the CENVAT on air guns manufactured in India is 14% and logically, a CVD at 14% should be applicable on its import.

The notification no 21/2008 of Customs has specifically mentioned removal of CVD in addition to the removal of basic custom duty. See this link…

http://indiabudget.nic.in/ub2008-09/cen/exnotecus.pdf

Against items of chapter 90 to 96, CVD has been specifically mentioned in addition to the basic custom duty. Compare it against items of other chapters where only basic duty removal/reduction has been mentioned. This has been done to make import of air guns really duty free. Another link…

See the penultimate line.

Remember, I am not arguing the situations people encounter, but only explaining the duty structure as it stands.

What avenues does one have to get this under the scanner ?
Because this is contrary to the ZERO duty clause.
Any lawyers willing to comment !

Point taken Sujay,

Wish we had this document along with us then maybe the guy wouldn't have levied it. He had asked whether there was anyway he could help us out but we didn't know what to do next.

Dear Dr. Viper,
I have imported an Air Rifle, 3 months back from U.S.of A. It was imported from Topairguns.
Their email is [email protected] . I had to produce My rifle club membership, Customs notification allowing .177 caliber air gun for rifle club members and the notification for Nil duty for .177 air guns.
In case you need the copies of these notifications, I shall be glad to send them by email. (Both are available on this forum.) Please contact by PM if you require them.
The duty charged was nil and the courier was Fedex.
BTW I am a native of Balasore, Which part of Orissa are you located?
Regards,
Prabir.
