I am assuming your query is related to arms "surrender" during elections.

I went through the judgment of Hon'ble Hight Court at Mumbai:
http://bombayhighcourt.nic.in/ for the case between Govind Tilve/Thakur vs District Magistrate(Sindhudurg), State of Maharashtra and Election Commission.

What I have understood reading the judgment as a layman is that:

1) Screen Committee is formed once elections are declared.

2) Screening committee identifies following people:
a) Persons released on bail
b) Persons having a history of criminal offences
c) Persons involved in rioting especially during elections

3) Licensing Authority on receiving the list of above category of people will issue notices to these license holders to deposit their firearms or else be prosecuted as per Section 188 of I.P.C.

As per my understanding of the judgment: If a person is not falling in any of the above 3 categories, then he should not be bothered.

Unfortunately the deposit of firearms in Hyderabad, during elections, while being followed on the directive of the Election Commission, is being enforced according to Section 21. As far as I know there is no reprieve from Section 21.
