Need guidance

Dear All,
We have 12 bore single barrel gun. My father was having valid license for it, it got expired around 5-6 years back. We have deposited the gun in the police station around 4 years back as instructed by Police deptt. because of safety factors during elections.

Now the Gun deposit slip is misplaced and my father has not renewed his license because of his health condition. He is 68 years old now.

Police person from the police station contacted us once to take back the gun but refused to return it back because we did not had deposit slip or license.

I asked my father about the license and he said it was deposited in the commissioner's office along with the document to renew the license. It receipt is also misplaced. (i contacted the license issuing authority and he was unable to trace the records because we did not had exact date of application for renewal of license)

I was denied gun license from Police deptt. once in (2003 or 2004) when I was applied to become carrier for the gun on the ground I was too young and financially not sound. Now I am 36 and regular income tax payer with clean record history in Police station.

Please guide me what is to be done to get back the gun?

These are the options I can think of:

1. Try to locate the deposit slip. Or try to locate its counterfoil with the police. Once counterfoil or corresponding records are located in the police station, you can officially lodge general diary in police station that your original deposit slip is lost and officially obtain the copy of corresponding details lying with police. You can also skillfully use RTI Act 2005 in this matter.

2. If police agrees to hand over the gun without deposit slip provided you have the arms license then apply and get an arms license.

Please note that you do not need to be an income tax payee or financially sound to get an arms license. Getting arms license is your right. Section 14(2) of Arms Act 1959 is very clear that arms license is not be refused merely because someone does not own or possess sufficient property. Income is also kind of property i.e. movable property.

Getting arms license for shotgun is your right rather a fundamental right. This matter has been discussed at number of places in this forum. Please search the legal eagle section of this forum using the search box. Some threads that I can remember are:

thanks for your valuable guidance and information. Using RTI is fantastic idea to trace police records for gun deposit.
